Terms of Service

By downloading, installing, or using TEX Wallet, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you must not use our application.

You must be at least 18 years old to use TEX Wallet. By using our application, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms of Service.

You are responsible for ensuring that your use of TEX Wallet complies with all applicable laws and regulations in your jurisdiction.

TEX Wallet is a non-custodial wallet, which means:

• We do not store, have access to, or control your private keys, seed phrases, or funds.

• You are solely responsible for maintaining the security and confidentiality of your private keys and seed phrases.

• We cannot recover your wallet, private keys, or funds if you lose them.

• We cannot reverse, cancel, or refund any transactions you make.

You acknowledge and accept full responsibility for the security of your wallet and the consequences of losing access to your private keys or seed phrases.

As a user of TEX Wallet, you agree to:

• Keep your private keys, seed phrases, and passwords secure and confidential.

• Not share your wallet credentials with any third party.

• Verify all transaction details before confirming any transaction.

• Comply with all applicable laws and regulations, including tax obligations related to cryptocurrency transactions.

• Not use TEX Wallet for any illegal activities, including money laundering, terrorist financing, or other criminal activities.

• Not attempt to hack, reverse engineer, or exploit vulnerabilities in TEX Wallet.

• Back up your wallet information regularly.

TEX Wallet provides the following services:

• A non-custodial wallet interface for managing cryptocurrency assets.

• Access to decentralized applications (dApps) and blockchain networks.

• Token swap functionality through third-party decentralized exchange protocols.

• Transaction history and portfolio tracking.

We do not provide:

• Investment, financial, or legal advice.

• Custody or storage of your private keys or funds.

• Guarantees of transaction success or blockchain network availability.

• Customer support for issues related to third-party services, dApps, or blockchain networks.

TEX Wallet integrates with various third-party services, including:

• Blockchain networks (Ethereum, TRON, Solana, Bitcoin, Binance Smart Chain)

• Decentralized exchange protocols for token swaps

• Price feed providers and data aggregators

These third-party services are not under our control, and we are not responsible for their availability, accuracy, or reliability. Your use of third-party services is subject to their respective terms and conditions.

We do not endorse, guarantee, or assume responsibility for any third-party services, dApps, or tokens accessible through TEX Wallet.

TEX Wallet may charge fees for certain services, which will be disclosed to you before you complete a transaction. These fees are separate from blockchain network fees (gas fees), which are determined by the respective blockchain networks and are beyond our control.

You are responsible for paying all applicable fees, including but not limited to:

• TEX Wallet service fees (if applicable)

• Blockchain network transaction fees (gas fees)

• Third-party service fees (e.g., swap protocol fees)

All fees are non-refundable unless otherwise stated.

You acknowledge and accept the following risks associated with using TEX Wallet and cryptocurrency:

• Cryptocurrency values are highly volatile and can result in significant financial losses.

• Blockchain transactions are irreversible. Once confirmed, transactions cannot be undone.

• Smart contracts and dApps may contain bugs, vulnerabilities, or malicious code that could result in loss of funds.

• Blockchain networks may experience congestion, delays, or failures that affect transaction processing.

• Regulatory changes may impact the legality or usability of cryptocurrencies in your jurisdiction.

• Loss of your private keys or seed phrase will result in permanent loss of access to your funds.

TEX Wallet is provided AS IS and AS AVAILABLE without warranties of any kind, either express or implied.

To the maximum extent permitted by law, TEX Wallet and its affiliates, officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from:

• Your use or inability to use TEX Wallet.

• Any unauthorized access to or use of your wallet or private keys.

• Any bugs, viruses, or other harmful code in TEX Wallet.

• Any errors, mistakes, or inaccuracies in content or transactions.

• Any loss or damage to your cryptocurrency assets.

• Any third-party conduct or content, including interactions with dApps or smart contracts.

Our total liability to you for any claims arising from your use of TEX Wallet shall not exceed the amount of fees, if any, that you have paid to us in the twelve (12) months preceding the claim.

You agree to indemnify, defend, and hold harmless TEX Wallet and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from:

• Your use or misuse of TEX Wallet.

• Your violation of these Terms of Service.

• Your violation of any applicable laws or regulations.

• Your violation of any rights of a third party.

• Any transactions you conduct using TEX Wallet.

You agree not to engage in any of the following prohibited activities:

• Using TEX Wallet for any illegal purposes, including money laundering, terrorist financing, or fraud.

• Attempting to gain unauthorized access to other users' wallets or private keys.

• Interfering with or disrupting the operation of TEX Wallet or its servers.

• Using automated tools, bots, or scripts to interact with TEX Wallet without our permission.

• Impersonating any person or entity or falsely claiming an affiliation with any person or entity.

• Collecting or harvesting personal information from other users.

• Transmitting any malicious code, viruses, or harmful software through TEX Wallet.

We reserve the right to investigate and take appropriate legal action against anyone who violates these prohibitions.

All content, features, and functionality of TEX Wallet, including but not limited to text, graphics, logos, icons, images, software, and code, are the exclusive property of TEX Wallet or its licensors and are protected by international copyright, trademark, and other intellectual property laws.

You may not copy, modify, distribute, sell, or lease any part of TEX Wallet or its content without our prior written consent. You may not reverse engineer, decompile, or attempt to extract the source code of TEX Wallet.

Your use of TEX Wallet is subject to our Privacy Policy, which explains how we collect, use, and protect your information. By using TEX Wallet, you consent to our data practices as described in the Privacy Policy.

As a non-custodial wallet, we do not have access to your private keys, seed phrases, or wallet balances. Your sensitive data is stored locally on your device and is not transmitted to our servers.

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law principles.

Any disputes arising out of or relating to these Terms of Service or your use of TEX Wallet shall be resolved through binding arbitration conducted by the Estonian Chamber of Commerce and Industry Arbitration Court, except where prohibited by law.

You agree to waive any right to a jury trial or to participate in a class action lawsuit regarding any disputes with TEX Wallet.

We reserve the right to modify these Terms of Service at any time. If we make material changes, we will notify you by posting the updated terms in the application or by other means of communication.

Your continued use of TEX Wallet after the changes take effect constitutes your acceptance of the modified Terms of Service. If you do not agree with the changes, you must stop using TEX Wallet.

You may stop using TEX Wallet at any time by uninstalling the application from your device. We reserve the right to suspend or terminate your access to TEX Wallet at any time, with or without notice, for any reason, including if we believe you have violated these Terms of Service.

Upon termination, your right to use TEX Wallet will immediately cease. However, as a non-custodial wallet, you will retain access to your funds through your private keys, even if your access to TEX Wallet is terminated.
